Conditions for using Retro Web Tools

Article 1 (Scope)

These Terms of Use ("these Terms") set out the conditions on which Retro Web Tools ("this site") provides its services and tools ("the Service"). By using the Service you are considered to have agreed to these Terms.

These Terms apply to both the Japanese and the English edition of this site. The handling of data is governed separately by the Privacy Policy.

This is an English translation of the original Japanese terms, provided for convenience. If the two versions differ, the Japanese version prevails.

Article 2 (The Service)

This site provides a range of free online tools, including text conversion, image processing, encoding and decoding, and format conversion.

Every tool runs client-side in your browser, and the data you enter is not transmitted to any server operated by this site. Some tools do, however, save settings or your work inside your own browser; the Privacy Policy lists exactly what is saved.

Article 3 (Charges)

The Service is provided free of charge. The cost of providing it is met through the advertising revenue described in Article 6. You are not required to pay this site anything in order to use the Service.

Article 4 (Your responsibilities)

You are responsible for satisfying yourself that you are entitled to use the data you enter into the Service, and that doing so does not breach any law, any contract with a third party, or any policy of an organisation you belong to.

The Service runs in your browser, but your organisation may nonetheless have its own rules about which websites may be used and how particular categories of information may be handled. Please check those rules before using the Service with material belonging to your work.

If your use of the Service gives rise to a dispute with a third party, you are responsible for resolving it at your own cost.

Article 5 (Prohibited conduct)

When using the Service, you agree not to:

  • place an excessive load on the servers or network of this site;
  • send large volumes of requests using automated tools;
  • interfere with the operation of this site, or act in a way likely to do so;
  • reproduce, republish or redistribute the content of this site without permission;
  • disassemble or decompile the programs that make up the Service;
  • interfere with the display of advertising, or generate advertising revenue improperly;
  • act in breach of any law or of public order and morals;
  • act in any other way that the operator of this site reasonably considers inappropriate.

Article 6 (Advertising and affiliate links)

This site carries third-party advertising served through Google AdSense, and product links provided through the Amazon Associates Programme. This site earns advertising revenue and referral fees through them.

The operator of this site has no involvement in the content of third-party advertising, or in the quality, safety or legality of the products and services linked from advertising and affiliate links, and is not liable for loss arising from them. Any purchase or contract is made between you and the provider concerned.

Article 7 (Intellectual property)

Intellectual property rights in the content of this site — text, design, source code, logos and so on — belong to the operator of this site or to the respective rights holders.

The fonts used by the Service, "Press Start 2P" and "VT323", are licensed under the SIL Open Font License 1.1. See the OFL License for details.

The ASCII art generator uses figlet.js (Copyright © 2014–present Patrick Gillespie and other contributors), licensed under the MIT License. FIGlet fonts are distributed under the modified BSD license.

This site claims no rights over the output produced or converted by its tools. You are free to use that output as you wish.

Article 8 (Disclaimer)

The Service is provided "AS IS". The operator of this site gives no warranty, express or implied, as to its accuracy, completeness, reliability, security, fitness for a particular purpose, or continued availability.

The operator of this site is not liable for loss or damage suffered through use of the Service, except where it results from the operator's wilful misconduct or gross negligence.

Where the operator is nonetheless liable, that liability is limited to direct and actual loss of a kind that ordinarily arises. Except in cases of the operator's wilful misconduct or gross negligence, the operator is not liable for loss arising from special circumstances, for lost profits, or for loss resulting from the loss of data.

When the output of a tool informs a professional judgement or the handling of important data, verify the result by other means.

Article 9 (Changes to and suspension of the Service)

The operator of this site may change the content of the Service, or suspend or discontinue it, without prior notice. Except in cases of the operator's wilful misconduct or gross negligence, the operator is not liable for loss this causes to users.

Article 10 (Changes to these Terms)

The operator of this site may amend these Terms where it judges this necessary, without notifying users individually. Amended Terms take effect from the moment they are published on this page, and the last-updated date below is revised.

Article 11 (Severability)

If any provision of these Terms, or part of a provision, is held to be invalid or unenforceable under the Consumer Contract Act or any other law, the remaining provisions, and the remainder of any partly invalid provision, continue in full force and effect.

Article 12 (Governing law and jurisdiction)

These Terms are governed by and construed in accordance with the laws of Japan. Any dispute relating to the Service shall be subject to the exclusive jurisdiction, in the first instance, of the district court having jurisdiction over the location of the operator of this site.
